General terms of trade when purchasing direct at our Clevedon store

1. Terms

Unless special terms are agreed to in writing these terms shall be deemed to be incorporated as conditions of any order or Contract accepted by the Company. “The Company” means Challicom & Company Limited, Company Registration number 282570 and “The Customer” means the person or Company to whom a quotation is addressed or whose order is accepted by the Company and “The Goods” means the subject of such quotation or order.

2. Orders

The Company’s acceptance of the Customer’s order is conditional upon the availability of the goods. If any of the goods ordered are unavailable the Company reserves the right to cancel the order and inform the Customer as soon as possible. It is the Customer’s responsibility to check that all details and aspects of the order are correct and suitable for their requirements, including sizes, product features, access and delivery. All dates given by the Company’s suppliers are quoted in good faith, but the Company will not be bound to supply the goods where there is a failure to supply the goods by the supplier. The Company will make every effort to honour delivery estimates, but can accept no liability for damages resulting from overdue deliveries within a reasonable time. A minimum of 20% of the total price of the goods must be paid as a deposit before the order will be processed.

3. Prices

Provided the required deposit is paid when the order is placed, all prices quoted are firm prices unless delivery is delayed by the Customer, in which case any charges incurred e.g. storage, levied by the Company’s suppliers, will be passed on to the Customer.

4. Web-site

To the fullest extent permitted at law, Challicom & Company Limited is providing this web-site and its contents on an "as is" basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this web-site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, Challicom & Company Limited does not represent or warrant that the information accessible via this web-site is accurate, complete or current. Price and availability information is subject to change without notice.

5. Cancellations & Returns (shop purchases only)

The Customer has the right to cancel the order, excluding carpets, any time up to 48 hours after placing the order. All home furnishings purchased from stock (excluding furniture, carpets, beds and bedding) can be returned with proof of purchase, unused and in the condition in which they were sold, within seven days of purchase for a credit note.

6. Payment

The balance shown on the Customer’s invoice must be paid by cleared funds prior to delivery. The Company accepts cash, cheques and most credit cards. (Please note cheques can take up to 4 working days to clear.)

7. Storage

Storage of goods can be arranged, for an agreed period, by prior arrangement, in writing, subject to the conditions of payment having been met.

8. Delivery

The Company’s delivery periods are – AM (between the hours of 08.00 and 14.00) or PM (between the hours of 12.00 and 18.00). Only in exceptional circumstances can the Company give a specific time for a delivery. The Company will make every effort to deliver within the specified delivery period given however, the Company reserves the right to change its delivery schedule, without notice, in the event of circumstances beyond its control.

It is the Customer’s responsibility to ensure that the goods ordered will fit into the address for delivery. There must be sufficient access for the Company’s delivery vehicle to reach the delivery address. It is the Customer’s responsibility to inspect the goods upon delivery and report any defects to the Company within a reasonable time. Non-standard, special and re-deliveries may incur additional charges. Prices and availability for deliveries requiring extra crew or a smaller vehicle are available on request.

9. VAT

Any changes in VAT rates or conditions legally imposed as to the charging of VAT to any applicable sale will have to be complied with and the appropriate adjustment made.

10. Customer Service

Challicom & Company Limited is an independent family business and prides itself on the way it cares for its Customers. The Company welcomes feedback from its Customers and uses it to further improve the services it provides.

11. Price Promise

If the Customer buys any item from stock and finds, within seven days of the invoice date, that the same item could have been purchased locally at a lower fully inclusive price, then the Company will refund the difference. This excludes Internet and catalogue sales.

Payment Processing

Once you have submitted your order and payment has been authorised you will receive an acknowledgement email from us and will be able to view your order in the account area of the website.

In the event there is insufficient stock to satisfy your order you will be informed via email or telephone as soon as possible.

All prices charged on this website are quoted in pounds sterling. The price you pay for your order is the price which is displayed on the website. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling your order.

All prices shown are inclusive of VAT where applicable.

Order Transaction

Returns - Online Purchases

Our Returns Policy

We want you to be delighted with your purchase but if you are not you can return any item within 30 days of receipt as long as it is unused and in its original packaging.

We will be happy to exchange the item for a replacement or to make a refund which will be processed to a debit/credit card or a customer’s own PayPal account depending on which method of payment was used when the purchase was made. We are not able to refund any postage charges, but we will send any exchange items free of postage charges.

Your Right To Cancel

You have a right to cancel your order within 7 working days of receiving your purchase. Please notify us by email on or in writing to Challicom & Co Ltd, 10 Hill Road, Clevedon, North Somerset BS21 7NZ that you wish to cancel your order and that you intend to return the item(s).

If you cancel the whole order we will refund the standard postage and packing costs you paid as part of that order(if any) in accordance with the Distance Selling Regulations. You will have to pay the costs of sending the order back to us.

We will not refund any postage and packing charges if you cancel after the 7 days allowed under the Distance Selling Regulations or if you only cancel part of the order. This cancellation right does not apply to the products listed as exclusions unless they are faulty – see section ‘Which Products are Excluded?’

To return any items, send a mesage via our contact page ensuring you quote your order number. The items should be returned by an agreed delivery method, you will be liable for costs any incurred.

Incorrectly Supplied Items

In the event that you receive incorrectly supplied goods, we will send a prompt replacement, refund or alternative item to the same value.

Which Products Are Excluded

Unless faulty, the following items are excluded from our Returns Policy: made to measure curtains & blinds, duvets and pillows. These items can only be returned in accordance with your legal rights.

How To Return Items

You should return your parcel by post. Please ensure you complete the delivery note with the details of the items you are returning and enclose the note with your returned parcel. It would help us if you could give a reason why the item(s) were not suitable. Please let us know whether you require an exchange or a refund and always include a daytime telephone number and your email address in case we need to contact you about the return.

Parcels are returned at your own cost and we strongly recommend you obtain a free certificate of postage from the Post Office as we are responsible for your parcel only once it has been received in store. Items lost in transit will not be treated as returned.

What If The Item Is Faulty?

We are always disappointed on the rare occasion our customers receive a faulty item. If you have identified the fault within 30 days, then you can return the item under our normal return procedure for exchange or refund. Make sure you let us know about the fault so that we can ensure other items are not affected. We will refund any standard postage & packing paid (if any) on a faulty item, and ensure you are reimbursed for standard return postage on the item.

If a fault develops outside of the 30 day return period, please email us on before you return the item so that we can discuss the fault with you and agree the best way forward. Please take extra care to read any specific product care instructions on the package. We cannot accept an item returned as faulty if the appropriate product care instructions have not been followed and the damage caused to the product is clearly due to wear and tear or misuse.

How Do I Arrange An Exchange?

If the product you require is still available we will exchange free of charge. If the new item you require costs less than the one you have returned we will refund you the difference. If it costs more than the one you have returned, we will need to take an additional payment from you before we can send you the item.

Cancellation by us

a) We reserve the right not to accept any order if:
- We have insufficient stock to deliver the goods you have ordered.
- We do not deliver to your area.
- One or more of the items ordered was incorrectly described or priced on our website.
- The payment transaction is not authorised.

b) If we do cancel your order we will notify you and will refund to you any sum paid by you to us in respect of the order within 30 days of the cancellation. We will not be obliged to offer any additional compensation for disappointment suffered.

Unforeseen Circumstances

While every effort is made to meet our customers’ demands, cancellations or variations may be necessary as a result of an Act of God, war, strike, lockout, labour dispute, fire, flood, drought, terrorist activity, civil riot or other causes beyond our reasonable control.

Entire Agreement:

These terms and conditions together with our current website prices, delivery details, contact details and Privacy Policy set out the whole of our agreement relating to the supply of goods to you by us.

Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods for sale by us.

Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Challicom & Company Ltd nor any of its Directors, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of this website.

This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

Challicom & Company Limited accepts no liability for any information or content contained in external third party websites which link to or from this website.

Notwithstanding the foregoing, none of these exclusions and limitations are intended to limit any rights you might have as a consumer under local or other statutory rights which may not be excluded nor in any way to exclude or limit our liability to you for death or personal injury resulting from our negligence or that of employees and/or agents.
